1. Scope of the General Terms and Conditions (T&C)

All deliveries, services and offerings of the Buffalo Boots GmbH (hereinafter: buffalo) shall exclusively be carried out on the basis of these General Terms and Conditions, unless explicitly otherwise agreed in writing by the parties. The latest version of the following General Terms and Conditions at the time of the order shall always apply.

Contractual conditions that are set forth by the customer or a third party shall not become contractual content, even if Buffalo does not object to the conditions.

3. Contract Conclusion

The depiction of the products on the buffalo online shop does not constitute a legally binding offer, but rather a non-binding e-catalog. By clicking on the “order now” button, you are submitting a binding order of the items contained in the shopping cart. Order acceptance is confirmed via an automated e-mail (“order confirmation”) immediately after sending the order and does not yet constitute acceptance of the contract.

The binding acceptance of the offer takes place only through delivery of the goods. We will inform you of this by e-mail in a separate shipping and contract confirmation ("order confirmation").

If you do not receive a shipment notification within 7 days after placing the order you are no longer bound to your offer / order. In case of unavailability of the ordered goods, we reserve the right not to deliver. In this case we will inform you immediately and refund any payments received.

You can track the status of your order in the "My Account" section under "Orders".

A purchase contract is concluded:

• when paying in advance at the time of the request for payment

• when paying by Giropay, PayPal, Paydirekt and sofortueberweisung with confirmation of the payment instruction to us

• for payment by credit card with completion of the ordering process

4. Import Regulations

Please follow the import regulations in your country and inform us of any particularities with the import regulations.

Additional customs duties and fees apply for deliveries to non-EU foreign countries. Please obtain more information from your local customs authorities.

Please keep in mind that orders to non-EU countries (e.g. UK) are subject to import duties and fees at the border. All additional costs are your responsibility and must be paid upon delivery.

Tax-free export delivery according to § 4 No. 1a in connection with § 6 Paragraph 1 UStG.

5. Price Information

The specified prices refer to the item published online with the matching description.

Prices are final prices and include the applicable statutory VAT; shipping costs are additional. Shipping costs are clearly displayed on the product pages, in the shopping cart and on the order page.

For selected releases, shipping costs may apply despite a “free shipping” badge. Final shipping costs are always shown transparently during checkout.

6. Payment

All sales prices must be paid immediately after contract conclusion via Klarna, PayPal, credit card, instant transfer or bank transfer.

Available payment methods:

• Instant transfer

• Prepayment (bank transfer)

• Credit card (MasterCard/Visa)

• Cash on delivery (Germany)

Klarna payment options include:

• Pay Later (14 days invoice)

• Slice it (installments)

• Pay Now

The use of invoice, installment or direct debit requires a credit check. Personal data is processed according to Klarna’s privacy policy.

7. Default

If the customer is in default of payment, buffalo may charge statutory default interest. Additional damage claims remain unaffected.

8. Objections and Offsetting

Objections to invoices must be submitted in writing within 14 days.

The customer may only offset claims with undisputed or legally established claims and only within the same contractual relationship.

9. Reservation of Title

The goods remain the property of buffalo until full payment has been received.

10. Liability and Warranty

Warranty and liability are governed by statutory provisions.

buffalo is liable for intent and gross negligence. Liability for slight negligence is limited to foreseeable damages.

The product liability law remains unaffected.

12. Complaint / Dispute Resolution

We inform you about the EU online dispute resolution platform provided by the European Commission:

Out-of-court dispute resolution is available via the platform.

buffalo does not participate in dispute resolution proceedings.

13. Delivery

Delivery times may be up to 5 days. Deviations are shown on product pages.

14. Statute of Limitations

The statute of limitations follows legal provisions.

15. Written Form Requirement

Contract changes must be made in writing. This also applies to waiving the written form requirement.

17. Cancellation Policy

17.1 Statutory Right of Cancellation

Right of Cancellation

Orders cannot be cancelled for technical reasons once submitted.

Non-EU customers: Orders are final and cannot be returned.
EU customers: You may return goods within 14 days without giving reasons.

Consequences of Cancellation

Refunds will be issued within 14 days after receiving the cancellation.

Goods must be returned within 14 days.

Germany: free return label included.
Other countries: return shipping costs must be covered by the customer.

17.2 Additional Information

Please include the return slip and original packaging if possible.

Returns can be sent via Deutsche Post, DHL Packstation or Paketbox.

18. E-Mail Advertising

We may use your email address to send product recommendations.

You may unsubscribe at any time via link in the email.

19. Final Provisions

German law applies, excluding the UN Sales Convention.

Invalid clauses do not affect the validity of the remaining contract.

buffalo may restrict access to the online shop in case of security risks.
